Why File a Personal Injury Claim?
After a serious accident, most people’s first priority is obtaining medical treatment. In fact, it is critically important that you seek medical care after any accident, no matter how minor it may seem. Unfortunately, this treatment is often very costly.
Additionally, injured victims may find themselves temporarily or permanently out of work, depending on the nature of their injuries. This further compounds financial concerns. And, of course, extensive injuries also cause extensive physical pain and emotional distress.
Often, the liable insurance company or another responsible party will offer a very low settlement that does not even come close to covering the cost of your damages. Insurance companies will even outright deny valid injury claims. This can leave victims and their families struggling to get back on their feet—even though the injuries and resulting consequences were caused through no fault of their own.
Compensation for your Personal Injury Case
While every situation is different, many personal injury plaintiffs are able to recover compensation for the following damages:
- Immediate emergency medical treatment
- Ongoing (including lifelong) medical care
- Lost income and/or wages
- Lost or reduced earning ability
- Pain and suffering
- Emotional and/or mental anguish
- Loss of enjoyment
In some cases, you may be able to seek punitive damages meant to punish responsible parties when negligence is particularly egregious. Additionally, if your family member was killed as a result of someone else’s careless, reckless, or negligent actions, you may be able to seek recovery for funeral costs, cost of pre-death medical treatment, loss of financial contribution and support, emotional distress, and more.

A statute of limitations is a legal timie limit on how long you have to bring certain cases to court. However, certain circumstances of your case can affect this time limit

Our Criminal Defense Practice
At The Law Office of Carlos A. García, PLLC, we strive to ensure that our clients’ constitutional rights are protected. Our criminal defense practice focuses on defending your rights, your future, and your freedom.
Our McAllen criminal defense attorney centers his practice on the following:
-
The Right to an Attorney: Sometimes taken for granted, this simple phrase is the backbone of our justice system. The accused’s right to counsel is founded in the Sixth Amendment to the Constitution and endorsed by Gideon v. Wainwright.
- Innocent Unless Proven Guilty: Whether you are arrested, indicted, or suspected of a crime, it is important to remember you are innocent unless proven guilty. A verdict of guilt must be proven beyond a reasonable doubt. We embrace this standard and believe that all individuals deserve fair and passionate representation at every stage of the judicial process. Without the counsel of your choice, you cannot ensure the representation you or your loved one deserves. Surely, when accused of a crime, a person needs to know the specifics of what he confronts. The Law Office of Carlos A. García, PLLC takes the time to explain the judicial process to our clients and his or her family.
- The Right of Confrontation: Seeking justice through the gauntlet of cross-examination distinguishes good lawyers from great ones. Many times, a witness’s true motivation for testifying against the accused is buried beneath a false facade created by a myriad of factors. Seeking out these motivations for testifying against the accused provides the “fact finder” (jury) true insight into the witness’s reasons for testifying. Ultimately, the witness’s credibility is judged by their ability to answer questions as confronted by the defense lawyer. A jury relies on both defense counsel and the lawyer for the government for providing a picture of evidence as described by witnesses.
- The Right against Self-Incrimination: The Fifth Amendment to the Constitution shields every individual from being a witness against himself. It is the government’s burden to prove the elements of their case. Whether or not to testify in a criminal prosecution is a personal right that must be thoroughly discussed prior to trial. In certain limited circumstances, the accused may choose to testify on his or her own behalf. Again, the testimony of the accused should be carefully analyzed and considered with defense counsel before and during trial.
Mr. García seeks to protect your rights by putting his experience in front of judges and juries to work for you or your loved one. The legal process is intimidating and challenging. Whether you are accused of a state or federal crime, Mr. García’s knowledge of the law and passion for the case sets him apart from the rest. He is Board-Certified in Criminal Law by the Texas Board of Legal Specialization, making him an expert in criminal law.
